The App is intended for users who are at least 18 years old. By using the App, you represent and warrant that you meet this age requirement.
You may be required to register an account to access certain features of the App. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
We grant you a non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.
In addition to this, Cheeta's services include access to downloadable software, like our desktop app. To enhance your experience, our software is designed to update automatically. These updates ensure you have the latest features and the highest level of security. Be aware that Cheeta's software might incorporate elements of open-source software. Such components are subject to their respective open-source licenses, and we'll ensure these licenses are accessible for your review where they are relevant.
You agree not to engage in any of the following prohibited activities:
Within the Cheeta ecosystem, your interaction involves providing input ("Input") and receiving corresponding output ("Output"). Together, these are your "Content". It's your responsibility to ensure that your Content is lawful and aligns with these Terms. You confirm that you hold all necessary rights and permissions to provide Input to Cheeta.
In our partnership, while using Cheeta, you maintain your ownership rights over your Input. As for the Output, it becomes yours too. We transfer to you any rights we may hold in that Output, within legal limits.
Given the nature of artificial intelligence and our services, Output may share similarities with that of other users. However, our assignment of rights to you does not extend to Output belonging to other users or third parties.
Cheeta uses your Content to enhance, maintain, and develop our services. This use is also for legal compliance, enforcing our terms, and ensuring the safety of our platform.
As AI evolves, we constantly refine Cheeta for greater accuracy and reliability. However, due to the probabilistic nature of machine learning, Output might not always perfectly mirror reality.
When using Cheeta, understand that Output may not be infallible. It's not a substitute for professional advice or a sole source of factual information. Always review Output for accuracy and suitability for your intended use, and refrain from using it for critical decisions affecting individuals.
Also, be aware that Cheeta's Output, including any unintended errors or offensive content, does not reflect our views or those of any third parties mentioned within.
All rights, title, and interest in and to the App (excluding content provided by users) are and will remain the exclusive property of Stealthmode LLC and its licensors.
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
At Cheeta, we strive to provide timely and helpful support to our users. However, we want to clarify that our ability to offer support is not guaranteed and may vary depending on various factors such as resource availability, the nature of the request, or volume of inquiries.
Please understand that while we make every effort to assist you, there may be circumstances where Cheeta cannot provide the level of support desired or within a specific timeframe. Our support services, when available, are offered as a convenience to you and do not form a binding obligation on us.
Your use of Cheeta acknowledges this limitation regarding support and you agree not to hold Cheeta, Stealthmode LLC, or its affiliates liable for any lack or delay of support services.
We reserve the right at any time to modify or discontinue, temporarily or permanently, the App (or any part thereof) with or without notice.
At Cheeta, and within our parent company Stealthmode LLC and its affiliates, we hold all proprietary rights, titles, and interests in the Cheeta Services. Our technology, services, and all related intellectual properties are under our exclusive ownership.
While using Cheeta, any use of our name, logo, or brand assets must align with our Brand Guidelines. These guidelines are designed to ensure our brand is represented consistently and respectfully. Unauthorized use or modification of our brand assets is strictly prohibited and may lead to legal action.
Respecting these terms helps maintain the integrity of Cheeta's brand and services, ensuring a trustworthy environment for all users.
We may terminate or suspend your access to the App immediately, without prior notice or liability, if you breach any of these Terms.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; or (c) unauthorized access, use, or alteration of your transmissions or content.
If you're engaging with Cheeta as a business entity or organization, this section is particularly pertinent to you. In line with legal allowances, your organization agrees to indemnify and hold harmless Cheeta, its parent company Stealthmode LLC, their affiliates, and all respective personnel. This indemnification covers any costs, losses, liabilities, and expenses (including reasonable attorneys’ fees) that arise from third-party claims. Such claims may be due to or in connection with your use of Cheeta’s Services and Content or from any breach of these Terms.
This indemnity is a crucial part of our agreement, ensuring that both parties - Cheeta and your business - can operate with a clear understanding of responsibilities, especially in legal contexts.
These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on the App.
